Annotation In Russia at the present time experience in the provision of outsourcing services is still not well understood. In the Russian Federation, outsourcing as a separate legal institution is not regulated by law. For registration of outsourcing services, civil contracts for paid provision of services are used. In this paper, the author is talking about the transfer of HR management functions, that is, the implementation of actions that do not have a material result, and the effect of their use will be manifested in the process of their implementation. The outsourcing contract must contain: a list of requirements to the contractor, a schedule of reports on the work done, a description of penalties and compensation for improper performance of works and delays in their execution, as well as an agreement on the confidentiality of the customer’s data. Since January 1, 2016, the provisions of the new Chapter 53.1 of the labour code of the Russian Federation have been issued. This term is translated from English as “moving staff out of the state”. Instead, the legislation of the Russian Federation introduced a new type of activity that allows you to perform actions to provide labor to employees. In connection with these innovations, the number of people who will be allowed to provide labour to employees will be very limited. The law also prohibits renting staff from companies that use preferential tax treatment. For the correct conclusion of an outsourcing agreement on paid provision of services, one should follow the provisions of Chapter 39 of the civil code of the Russian Federation, in particular, take into account that the agreement must be consensual, i.e. concluded from the moment of agreeing on essential conditions, bilateral and paid
